1. Acceptance of these Terms

Welcome to the website of Quality Express Freight ("Quality Express Freight", "we", "us" or "our"), a freight forwarding and logistics company headquartered at Green & View, Barsha Heights (Tecom), Dubai, United Arab Emirates. These Terms of Use ("Terms") govern your access to and use of qualityexpressfreight.com and any associated pages, tools, forms and content (together, the "Website").

By accessing, browsing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Website. If you use the Website on behalf of a company or other legal entity, you represent that you are authorised to bind that entity to these Terms.

We may update these Terms from time to time as set out in section 9. Your continued use of the Website after any change takes effect constitutes acceptance of the revised Terms.

2. Quotes and estimates are indicative — not a contract of carriage

Any rate, price, quotation, estimate, transit time, sailing schedule, cut-off, chargeable weight or other figure displayed on, generated by, or communicated through the Website (including any online enquiry form, calculator or instant-quote tool) is provided for general information and indicative planning purposes only.

Such figures:

do not constitute an offer capable of acceptance, a firm rate, or a binding contract of carriage;
are estimates that may vary with actual cargo particulars, weight and dimensions, commodity and HS classification, packing, Incoterms (Incoterms® 2020), routing, carrier availability, fuel and currency fluctuations, port and airline surcharges, peak-season demand, government charges, applicable duty (generally 5% in the UAE) and VAT, and other factors beyond our control;
exclude Dubai Customs charges, Mirsal 2 declaration fees, inspection, demurrage, detention, storage and similar third-party costs unless expressly stated in writing; and
remain subject to survey, confirmation and formal written acceptance by us.

Any transit or delivery time referred to on the Website is a good-faith estimate expressed as an indicative range and is not guaranteed. Transit performance depends on carriers, customs authorities, free-zone and port operations (including Jebel Ali/JAFZA, DP World, and DXB and DWC airports) and other third parties.

3. Freight services are governed by separate trading conditions

The Website does not itself create any carriage, forwarding, warehousing or logistics contract between you and us. Any freight forwarding, air, sea/ocean, land/road, express, relocation, customs clearance, door-to-door, warehousing, project cargo, dangerous goods or temperature-controlled service that we actually perform is provided under, and governed exclusively by, our separate standard trading conditions and/or a signed service agreement, booking confirmation, quotation, or bill of lading / air waybill (together, our "Standard Trading Conditions"), together with the mandatory international conventions and UAE laws that apply to the relevant mode of transport.

In the event of any conflict between these Terms and our Standard Trading Conditions in respect of freight services actually rendered, the Standard Trading Conditions shall prevail. 4. Intellectual property

All content on the Website — including text, graphics, logos, trademarks, service marks, images, page layout, design and software — is owned by or licensed to Quality Express Freight and is protected by applicable intellectual property laws. The "Quality Express Freight" name and logo are our marks and may not be used without our prior written consent.

You may view and print pages from the Website for your own internal, non-commercial reference. You must not otherwise copy, reproduce, republish, distribute, modify, frame, scrape, data-mine or create derivative works from any part of the Website without our prior written permission. All rights not expressly granted are reserved.

5. Accuracy of information

We take reasonable care to keep the Website accurate and up to date, drawing on our 40 years in the freight and logistics business. You should not rely on Website content as a substitute for professional, legal, customs or regulatory advice specific to your shipment.

The Website may contain links to third-party websites, carriers, port and customs authorities, or other resources for your convenience. Such links do not signify our endorsement, and we have no control over, and accept no responsibility for, the content, availability, accuracy or practices of any third-party site. Access to any linked site is entirely at your own risk and subject to that site's own terms and privacy policies.

7. Limitation of liability

To the fullest extent permitted by the applicable laws of the United Arab Emirates, Quality Express Freight, its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your access to, use of, or inability to use the Website, or any reliance on its content, whether based in contract, tort (including negligence) or otherwise.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under UAE law. This section 7 relates to your use of the Website only. Our liability in respect of freight services actually performed is governed exclusively by our Standard Trading Conditions (section 3).

You agree to indemnify, defend and hold harmless Quality Express Freight and its directors, employees and agents from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Website, or your violation of any applicable law or the rights of any third party.

We may revise these Terms at any time to reflect changes in our services, technology, or legal and regulatory requirements.
